By accessing or using Creato ('the Platform'), you agree to be bound by these Terms and Conditions ('Terms'). If you do not agree to these Terms, you may not access or use the Platform.

These Terms apply to all users of the Platform, including visitors, registered users, and paying subscribers. We may update these Terms from time to time, and your continued use of the Platform constitutes acceptance of any changes.

Creato is an AI-powered creative platform that provides tools for image generation, content creation, editing, scheduling, and multi-platform publishing. The Platform integrates multiple AI models and offers features including Studio, Canvas, Cinema, Chat, and Publish.

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You must be at least 13 years of age to use the Platform. If you are under 18, you must have parental or legal guardian consent.

Creato offers free and paid subscription tiers (Pro and Team). Paid subscriptions are billed on a recurring monthly basis. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

Prices are subject to change with reasonable notice. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.

Free tier accounts are subject to usage limits as described on our pricing page. Exceeding these limits may require upgrading to a paid plan.

All payments made for subscriptions, credits, and add-on purchases are final and non-refundable. By subscribing to a paid plan or making any purchase on the Platform, you acknowledge and agree that no refunds will be issued under any circumstances.

You may cancel your subscription at any time to prevent future charges. Cancellation will take effect at the end of the current billing period, and you will retain access to paid features until that date. No partial refunds or credits will be provided for unused portions of a billing period.

The Platform uses third-party AI models to generate images, text, and other creative content. You understand that AI-generated outputs may not always be accurate, appropriate, or free from errors.

You retain ownership of the prompts and inputs you provide to the Platform. For content generated using the Platform, ownership and usage rights depend on your subscription tier and the terms of the underlying AI model providers.

You agree not to use the Platform to generate content that is illegal, harmful, defamatory, obscene, or infringes on the intellectual property rights of others.

You agree not to use the Platform to: (a) violate any applicable laws or regulations; (b) generate deepfakes or misleading content intended to deceive; (c) create content that exploits or harms minors; (d) harass, abuse, or threaten others; (e) infringe on intellectual property rights; (f) attempt to reverse-engineer, decompile, or extract the underlying AI models; (g) overload, disrupt, or interfere with the Platform's infrastructure.

We reserve the right to suspend or terminate accounts that violate these usage policies without notice or refund.

The Platform may allow you to publish content directly to third-party social media platforms. You are solely responsible for the content you publish and for complying with the terms of service of those third-party platforms.

By using the publishing features, you grant Creato a limited license to transmit your content to the designated third-party platforms on your behalf. This license terminates when you disconnect your accounts or delete the content.

The Platform, including its design, code, features, branding, and documentation, is owned by Creato and protected by intellectual property laws. Nothing in these Terms grants you any right to use the Creato name, logo, or trademarks.

You retain all rights to original content you upload to the Platform. By uploading content, you grant Creato a limited license to process, store, and display that content as necessary to provide the Platform's services.

To the maximum extent permitted by law, Creato and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or goodwill.

Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to Creato in the twelve months preceding the claim.

The Platform is provided 'as is' and 'as available' without warranties of any kind, whether express or implied.

You may terminate your account at any time by contacting us or through the account settings. We may terminate or suspend your account at any time for any reason, including violation of these Terms.

Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration or in the courts of competent jurisdiction.
